Terms of Service

01Acceptance of these terms

remain.fit (the "Service") is operated by BYTSOLV DIGITAL TRANSFORMATIONS PRIVATE LIMITED, a company incorporated in India (CIN: U62099KL2023PTC083187), registered at 37/1993, Infra Futura Building, 8th Floor, Kakkanad, Thrikkakara, Ernakulam, Kerala, India, 682021 ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

02Eligibility

You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

03The Service & health disclaimer

remain.fit provides tools that let you record and observe aspects of your own routine, such as fasting windows. The Service is built on a principle of observation over judgment: it states what is happening and gets out of the way.

You use the Service and act on any information it presents at your own discretion and risk.

04Your account

You sign in using Google or Apple. You are responsible for keeping access to your sign-in method secure and for all activity under your account. Tell us promptly at legal@remain.fit if you suspect unauthorised use. We may suspend or terminate accounts that violate these Terms.

05Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of any applicable law;
• attempt to access accounts or data that are not yours;
• probe, scan, disrupt, or overload the Service or its infrastructure;
• reverse engineer, copy, or resell the Service except as permitted by law;
• use automated means to access the Service in a way that harms it or other users;
• upload malicious code or content that is unlawful, infringing, or harmful.

06Paid features & billing

Parts of the Service are free. We may offer paid features or subscriptions ("Paid Features"). If you purchase Paid Features:

• Fees & billing. Prices and billing periods are shown at the point of purchase. Fees are charged through our payment processor or the applicable app store, and may be exclusive of taxes, which you are responsible for.
• Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel beforehand. You can manage or cancel your subscription in your account settings or through the app store where you subscribed.
• Refunds. Except where required by law, fees are non-refundable. Where a purchase was made through an app store, refunds are governed by that store's policies.
• Changes. We may change prices for future billing periods; we will give reasonable notice before a change takes effect.

07Your content & data

The data you create in the Service — your fasting sessions, settings, and related records — remains yours. You grant us a limited licence to store, process, and display that data solely to provide the Service to you. We handle your data as described in the Privacy Policy. You can edit or delete your data, and delete your account, at any time.

08Intellectual property

The Service, including its software, design, tools, text, and the remain.fit name and logo, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not transfer any of those rights to you. You may use the Service only as permitted here.

09Third-party services

The Service relies on third parties, including Google Firebase (authentication, database, hosting), Apple (Sign in with Apple), and payment processors. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services, and their availability may affect the Service.

10Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be preserved. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

11Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. To the extent our liability cannot be excluded, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or ₹5,000.

12Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any rights of a third party.

13Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

14Changes to the Service & terms

We are actively developing remain.fit and may add, change, or remove features. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

15Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights you may have, the courts at Ernakulam, Kerala, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before commencing proceedings, both parties will attempt in good faith to resolve the dispute by contacting legal@remain.fit.
